Welcome to bhvco.com.au (the “Site”), operated by BHV Co Pty Ltd (ABN 74 694 603 033) (“BHV Co”, “we”, “us” or “our”). By accessing the Site or placing an order, you agree to these Terms & Conditions (“Terms”). Please read them carefully. If you do not agree to these Terms, you should not use the Site.

1. Eligibility

Our products are intended for adults. You must be at least 18 years of age to purchase from the Site. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate and complete.

2. Our products – important health information

BHV Co products are dietary supplements. They are not intended to diagnose, treat, cure or prevent any disease, and information on the Site is provided for general information only – it is not medical advice and should not be relied on as a substitute for advice from a qualified health professional.

•     Always read the label and follow the directions for use.

•     Supplements should not replace a balanced diet and healthy lifestyle.

•     If you are pregnant or breastfeeding, taking medication, or have a medical condition, consult your health practitioner before use.

•     Individual results vary. Any testimonials on the Site reflect individual experiences and are not a guarantee of results.

3. Orders and acceptance

Your order is an offer to purchase. An order is accepted when we send you an order confirmation and payment has been processed successfully. We may decline or cancel an order (for example, where a product is unavailable, there is a pricing or listing error, or we suspect fraud); if we do, we will refund any amount you have paid for that order.

4. Pricing and payment

All prices on the Site are in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. Shipping charges are additional and shown at checkout. We may change prices at any time, but changes will not affect orders we have already accepted. Payment must be made in full at the time of order using the payment methods offered at checkout, which are processed by secure third-party payment providers.

5. Subscriptions

Where you purchase a product on subscription:

•     your nominated payment method will be charged automatically at the recurring interval shown at checkout, at the subscription price current at the time of each renewal;

•     there is no minimum term – you may pause, skip or cancel your subscription at any time before your next billing date, through your account on the Site or by emailing orders@bhvco.com.au;

•     changes made after a billing date has been processed will apply from the following billing cycle, and orders already processed will be dispatched as normal; and

•     we may vary subscription pricing or benefits by giving you notice before your next billing date, and you may cancel if you do not wish to continue.

6. Shipping, returns and refunds

Delivery is governed by our Shipping Policy, and returns and refunds are governed by our Returns Policy, both available on the Site and incorporated into these Terms. Nothing in those policies or these Terms excludes your rights under the Australian Consumer Law.

7. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8. Intellectual property

All content on the Site – including the BHV Co name and logo, product names, text, images, videos and designs – is owned by or licensed to BHV Co and is protected by intellectual property laws. You may not reproduce, modify, distribute or use our content for commercial purposes without our prior written consent.

9. Acceptable use of the Site

You agree not to misuse the Site, including by interfering with its operation or security, scraping or harvesting data, uploading malicious code, or using the Site for any unlawful purpose. Any reviews or content you submit must be accurate, your own, and not offensive or unlawful; by submitting content you grant us a non-exclusive, royalty-free licence to use it in connection with our business, and we may moderate or remove submitted content at our discretion.

10. Liability

To the maximum extent permitted by law (and subject always to the Australian Consumer Law and clause 7), we exclude all liability for indirect or consequential loss arising out of your use of the Site or our products, and our total liability to you in connection with any order is limited, at our election, to resupplying the relevant products or refunding the amount you paid for them. Nothing in these Terms limits any liability that cannot be limited by law.

11. General

We may update these Terms from time to time; the version published on the Site at the time you place an order applies to that order. If any part of these Terms is found to be invalid, the remainder continues in effect. These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
